Understanding Your Notice Period
The Fair Work Act 2009 sets out minimum notice periods that apply to all permanent employees (full-time and part-time). Your contract may specify a longer notice period, but it cannot be shorter than the NES minimum.
Key Points for MSP Employees
Your contract might say something different: Many MSP contracts specify a 2-week or 4-week notice period as standard. Check your contract β the longer period applies between the NES minimum and your contract.
Probation periods: Most MSPs have a 3-6 month probation period during which the notice period is typically 1 week. After probation, the standard notice period applies.
Payment in lieu of notice: Your employer can choose to pay you instead of having you work your notice period. This is common in MSPs, especially for security-sensitive roles or when the relationship has broken down.
Garden leave: Some MSPs require you to stay home during your notice period (garden leave) while still being paid. This is often used when you're moving to a competitor.
